Terms and Conditions
1. All purchases of a voucher for a hot air balloon experience must be made through our office. Vouchers may be ordered by telephone or by filling out one of our booking forms. You must present this voucher when booking in at the flight to be allowed on board. One voucher enables one person to fly.
2. This contract is made with you. You can give the voucher to someone else provided you inform us of your intention to do so. These Terms and Conditions will still apply and “you” in the rest of the Terms and Conditions will refer to that person. Flights may be conducted by other Civil Aviation Authority authorised operators to increase flight availability. Your voucher and flight experience will however, still be bound by York Balloons Terms and Conditions.
3. It is our intention that all the terms of the contract between us are contained in these Terms and Conditions, and in any brochures and associated documents (if any) issued by us. If you wish to rely upon any variation in these terms you should ensure that we agree the variations in writing at the time of booking.
4. The voucher is not redeemable for cash.
Our Obligation to You
5. The voucher will entitle you to participate in a hot air balloon flight experience at a date to be arranged between you and our office. Flights will include:
a. A safety briefing by your pilot.
b. The preparation and inflation of the balloon for flight.
c. A flight in a hot air balloon.
d. The recovery of the balloon at the end of the flight.
e. A traditional balloon toast, with an opportunity to discuss the flight with your pilot.
6. Hot air balloon flights are completely dependant upon the weather and are regulated by the Air Navigation Order. It may be necessary to postpone a flight at any time if in our judgement the conditions are not safe or the flight would not be permitted under the Air Navigation Order. We will give you as much warning as operational procedures allow in case of postponement, but in order to ensure your safety we reserve the right to postpone a flight at any time up to the moment of launch.
7. It is intended that the balloon will be in the air for approximately 1 hour. However the pilot has the ultimate responsibility for deciding the duration and conduct of any flight and the appropriate time and place of landing. We cannot guarantee that your flight will follow any particular direction.
8. If we have to postpone your flight for matters beyond our control you will be entitled to re-schedule, providing your voucher is still valid. If you have re-scheduled 8 times or more within the main flying season then your voucher will be extended at no extra charge.
9. We and our associates carry insurance cover against the risk of injury to any passenger during the course of our flights in accordance with international agreements covering air transport. We will not be liable for any death or personal injury above the level of our insurance cover. We accept no liability for any loss or damage to equipment and effects brought with you on the flight.
10. We do not accept liability for any cost or expense you incur if we have to postpone any flight where the reason for postponement is beyond our control.
Your Obligation to Us
11. If you need to change your booking we require 7 days notice, before the flight meeting time booked for your flight. In exceptional circumstances or for medical reasons (where supported by a doctors note) it may be possible to change your booking with less notice.
12. Tickets are valid for 12 months from purchase but we require you to call and book a flight within 3 months of purchase to activate the ticket.
13. If you do not give notice in accordance with these Terms and Conditions, or do not attend in time to take part in your booked flight, you will not be entitled to a re-scheduled flight or any refund.
14. We are not qualified to express an opinion confirming that you are fit to fly, you must ensure that you are fit to fly. You must not fly if you are suffering from any serious medical conditions, or have recently undergone surgery, unless you have a certificate of your fitness to fly from your doctor. You must not fly if you are pregnant or under the influence of alcohol or drugs.
15. Our paramount consideration is your safety and the safety of others participating in the flight, you must obey all requests and instructions issued by any of our representatives and take particular care to abide by any safety instructions given. The pilot has complete discretion as to whether to allow you to take part in the flight and will refuse to allow you to do so if in his opinion you would be a risk to the balloon, the other passengers or to yourself.
16. We do not fly children under the age of 7 years. A child under the age of 16 will only be flown if accompanied by a responsible adult.
17. You should wear appropriate clothing as advised to you, see FAQ's.
18. There is a 7 day cooling off period after the purchase of a flight voucher, during this period a cancellation fee of £20 applies. After this it is non-refundable.
